1. Acceptance of Terms

Welcome to Fortune Pharmacal Co., Ltd.'s ("the Company", "we", "us") online store ("eShop"). By using our eShop or any part of it, you agree that you have read, understood, and accept the following Terms of Use. The Company reserves the right to modify or update these terms at any time without providing any prior notification. Modified terms will take effect upon publication. Your continued use of the eShop constitutes acceptance of the latest version of the terms.

2. General Terms

  • Pricing & Promotions: Selling prices and promotions on our eShop may differ from other retail stores. All prices are based on the date you place your order.
  • Order Confirmation & Availability: All orders are subject to confirmation of final availability. The Company reserves the right to decline any order for any reason. For the avoidance of doubt, any order receipt or automated confirmation email issued by the eShop only represents an acknowledgement of your order request and does not constitute acceptance of the order. A binding sales contract is only formed when we issue a dispatch notification or physically ship the products to you. If we are unable to fulfil any products or services in your order, we will notify you by phone or email before delivery.
  • Age Restrictions: If your order includes age-restricted products (such as alcohol or specific medications), you confirm that you have reached the legal age. The Company may require identity verification.

3. Registration & Account Management

  • Registration Requirement: You must register an account before shopping on our eShop. During registration, you must provide accurate, complete, and up-to-date information.
  • Account Security: You must safeguard your username and password. The Company assumes that any activity using your account is either by you or by someone authorized by you.
  • Information Updates: You must immediately notify the Company of any changes to your information so we can communicate with you effectively.
  • Account Deactivation: If your account is not used for a specified period (currently 3 years), the Company will deactivate your account without providing any prior notification. All accumulated reward points and/or e-vouchers will be forfeited (where applicable). To continue shopping, you will need to reapply for a new account.
  • Account Termination: The Company reserves the absolute right to refuse or terminate any customer account for any reason whatsoever.

4. Payment Terms

  • Accepted Payment Methods: Our eShop accepts credit cards (Visa, MasterCard, American Express, UnionPay) payment methods.
  • Currency & Amount Limits: All prices are in Hong Kong dollars. The minimum order amount is HK$50. If paying with a credit card, the maximum transaction limit is HK$10,000.
  • Security: The Company uses Internet Transport Layer Security (TLS) technology to encrypt your personal information, including credit card numbers, name, and address. 5. Product Inspection & Exchange Claims

  • Inspection Responsibility: You should examine products immediately upon delivery for any deficiencies, damages or incorrect deliveries.
  • Return and Exchange Policy: For hygiene and safety reasons, products sold on our eShop are generally non-returnable and non-refundable. You may only apply for an exchange if the product was damaged upon delivery or delivered incorrectly. All exchange claims must be lodged within 7 days from the date of delivery (based on the delivery record) and must strictly adhere to our Return & Exchange Policy. 6. Intellectual Property
All content on our eShop, including text, images, photographs, video images, logos, designs, and software, is the intellectual property of the Company or its licensors. “Intellectual property” means any and all patents, trade marks, rights in domain names, rights in designs, copyright and database rights (whether registered or not), rights in confidential information and all other intellectual property rights of a similar or corresponding character which may subsist now or in the future in any part of the world. Without the Company's written consent, you may not reproduce, modify, distribute, or use any content (including its intellectual property) from our eShop for commercial purposes.

You represent, warrant and covenant that you will not use our eShop to do any of the below prohibited activities:

The Company is not liable for any of the followings: indirect or consequential damages, losses or expenses, data loss, business interruption, or any delays or failures to perform caused by any reason, including causes beyond the Company's control.
  • Force Majeure: The Company shall not be liable for any delay or failure caused by acts of God, fire, flood, accident, riot, war, government intervention, strikes, equipment failures, or other causes beyond the Company's control.
  • Delivery Delays: If delivery is delayed, postponed, or rescheduled due to traffic, weather, district, delays by third-party logistics providers, or any other factors beyond the Company’s reasonable control, the Company shall not be liable for any loss or damage. 13. Entire Agreement

These Terms of Use, together with our Privacy Policy, Return & Exchange Policy and Shipping Policy, constitute the entire agreement between you and the Company, superseding all prior agreements or understandings.
